Recent Successes & Achievements

  • On November 12, 2009, Jonathan Klein and Katie Weeks obtained a binding arbitration award on behalf of Rite Aid Corporation in the matter of Ortiz v. Rite Aid. The United Food and Commercial Workers’ Union, Local 1167, brought the matter to arbitration claiming that Rite Aid had violated its labor contract when it failed to grant retail employees’ requests for weekday-only schedules. The arbitrator ruled that Local 1167 failed to establish its burden of proof and that Rite Aid had fulfilled its duty under the labor contract to “attempt to accommodate” scheduling requests, in so far as the scheduling accommodation was operationally practical for Rite Aid.
  • On October 30, 2009, Jonathan Klein and Katie Weeks obtained a dismissal, with prejudice, of the lawsuit entitled Mohsenzadegan v. Thrifty Payless, Inc., involving plaintiff’s claims of defamation, false imprisonment, assault and battery. The action was voluntarily dismissed, in exchange for a waiver of costs, in the discovery phase.
  • On June 5, 2009, Katie Weeks and Jonathan Klein succeeded in obtaining a binding arbitration award on behalf of Rite Aid Corporation by arguing that Rite Aid had good and sufficient cause to terminate an employee who furnished alcohol to a minor in violation of Rite Aid’s company policies and California Alcoholic Beverage Control laws. The arbitrator awarded in favor of Rite Aid over the Union’s argument that putting alcoholic beverages in the car of a minor did not constitute “furnishing” under California law as long as the minor did not drink the alcohol.
  • On April 9, 2009, Katie Weeks and Jonathan Klein obtained a $444,644.45 judgment, with attorneys’ fees, in Oregon state court in the case of Thrifty Payless, Inc., dba Rite Aid v. Dralle. The court awarded judgment against a former Rite Aid employee accused of fraudulently inducing Rite Aid to issue payments to sham companies, formed for the sole purpose of defrauding Rite Aid.  Shortly after commencing the lawsuit, Ms. Weeks and Mr. Klein won prejudgment attachment of the defendants’ cash assets and real property. The court applied the attached property to satisfy the judgment.

  • Employment litigation, including wrongful termination, retaliation and discrimination claims, as well as pharmacy law, administrative law, personal injury, premises liability and commercial litigation.

Activities

  • From 2004-2007, Katie served as volunteer and student president of the General Assistance Advocacy Program, a student-run nonprofit organization in San Francisco’s Tenderloin neighborhood dedicated to helping homeless San Franciscans obtain access to public benefits, housing and employment.
